Release of Liability & Assumption of Risk
I understand that participation in activities offered by SB Performance & Recovery LLC ("SB Performance"), including batting cage rentals; baseball and softball training; strength and conditioning; speed and agility; personal training; group fitness; basketball and volleyball activities; golf simulator use; recovery services; sauna; Normatec compression therapy; sports performance testing; camps, clinics, leagues, tournaments, events; and any other activities on or off the premises — involves inherent risks that may result in serious injury, illness, permanent disability, paralysis, death, or property damage. I voluntarily assume all such risks.
Medical Acknowledgment
I certify that I (or my minor child) am physically fit to participate. SB Performance, its owners, employees, contractors, trainers, volunteers, affiliates, sponsors, and landlords do not provide medical advice or treatment. It is my responsibility to consult a physician regarding participation in physical activities and recovery services.
Recovery Services Acknowledgment
Recovery services may include infrared sauna, compression therapy (Normatec), stretching, mobility work, recovery equipment, and other wellness modalities. These services are not medical treatments and are not intended to diagnose, treat, cure, or prevent any disease or condition. I participate at my own risk.
Batting Cage & Sports Activity Acknowledgment
Baseballs, softballs, bats, training equipment, golf balls, and other sporting equipment may cause serious injury. I agree to follow all posted rules; use equipment properly; wear appropriate protective equipment; follow staff instructions; supervise minor children under my care; and immediately report unsafe conditions. Failure to follow facility rules may result in removal without refund.
Release of Liability
To the fullest extent permitted under California law, I hereby release, waive, discharge, and covenant not to sue SB Performance & Recovery LLC, its owners, officers, directors, members, managers, employees, contractors, trainers, volunteers, affiliates, sponsors, landlords, and agents from any and all claims, demands, damages, causes of action, liabilities, costs, or expenses arising from participation in activities or use of the facility, including those caused by ordinary negligence. This release applies to personal injury, illness, disability, death, property damage, and economic loss.
Indemnification
I agree to indemnify, defend, and hold harmless SB Performance & Recovery LLC from any claims, damages, liabilities, costs, or attorney fees arising from my actions or the actions of my minor child while participating in facility activities.
Minor Participant Agreement
If the participant is under 18, the parent or legal guardian signing below agrees to all terms of this agreement; assumes all risks on behalf of the minor; and releases and indemnifies SB Performance & Recovery LLC on behalf of the minor.
Governing Law & Severability
This Agreement is governed by the laws of the State of California. Any legal action shall be brought exclusively in the courts located in Los Angeles County, California. If any provision is unenforceable, the remaining provisions remain in full force.
